General Terms & Conditions – European DMT Market
Article 1. Definitions
1.1. European DMT Market:
European DMT Market is a website and brand owned and operated by a Dutch company and governed by Dutch law. All agreements, conditions, and contracts below apply to this company trading as European DMT Market. Full company and contact information is listed in Article 14: Contact Information.
1.2. Customer:
A natural person who is not acting in a professional or business capacity and who enters into an agreement with European DMT Market through the purchase of goods or services or by using the European DMT Market website.
1.3. General Terms:
All conditions stated within this document.
Article 2. Relevance / Execution
2.1. These General Terms apply to all offers, agreements, deliveries, products, purchases, and use of the website www.europeandmtmarket.com, unless explicitly stated otherwise in writing.
2.2. By purchasing any product, creating an account, or using the website, the customer agrees to these General Terms.
2.3. Any provisions included by the customer that differ from these terms are only binding if explicitly accepted in writing by European DMT Market.
2.4. European DMT Market may engage third parties to execute its contracts.
Article 3. Offers
3.1. If customer-provided information appears incorrect and prevents order processing, European DMT Market may retract the offer and adjust pricing.
3.2. European DMT Market may retract, adjust, or change offers at any time.
Article 4. Prices
4.1. All prices include 21% VAT and applicable Dutch taxes.
4.2. Prices and offers may contain typographical errors and may be corrected at any time. If payment was made at an incorrect price, the order may be cancelled and refunded.
4.3. Delivery costs are included in the final total unless otherwise stated.
Article 5. Order Process, Payment & Shipping
5.1. Payments must be made in advance using the methods shown during checkout.
5.2. European DMT Market may terminate or suspend the contract without notice in the event of non-compliance or other justified concerns.
5.3. After electronic acceptance of an offer, the customer receives an electronic confirmation. Without this confirmation, the customer may terminate the agreement.
5.4. Orders are processed only after payment is received.
5.5. Payment platforms are third-party providers. Customers enter into separate agreements with these platforms. European DMT Market is not liable for payment processing issues.
5.6. After receiving payment, orders are typically shipped within 1 working day. Working hours are 9am–5pm CET, Monday–Friday, excluding holidays.
5.7. Working hours may be adjusted. Changes will be announced via newsletter and website.
5.9. Orders ship from the Netherlands, Czechia, or Germany.
5.10. Customers are fully responsible for ensuring the legality of purchased products in their own country. European DMT Market is not liable for violations of laws outside the Netherlands.
5.11. European DMT Market may withhold shipments to certain jurisdictions.
No chemical products are shipped to the UK, USA, Sweden, Thailand, Denmark, and Austria.
Merchandise, headshop items, and nootropics may ship worldwide.
Illegal or restricted products will never be shipped.
5.12. Once payment is received, ownership transfers to the customer. European DMT Market fulfills the contract by shipping the goods to the address provided.
5.13. Customers are encouraged to inspect goods immediately and report defects within 14 days (see Article 10).
5.14. Returns are not accepted due to the perishable nature of the products.
5.15. If items are out of stock, customers will be notified and may cancel or modify the order.
5.16. Normal maximum delivery times:
– 30 days within Europe
– 45 days worldwide
Delays beyond these times must be reported to European DMT Market for investigation.
5.17. Goods remain property of European DMT Market until full payment is received.
5.18. Once shipped, all risks—including legal risk—transfer to the customer.
5.19. Orders are packaged discreetly and securely.
5.20. European DMT Market is not responsible for postal delays once the package enters the postal system.
5.21. Two shipping options:
– Untracked: No reshipments for lost packages.
– Tracked: 100% reshipment if not received after 30 days (EU) or 45 days (worldwide).
5.22. No reshipments for orders seized by Customs or law enforcement.
Article 6. Liability
6.1. This liability clause applies to customers acting in a business or professional capacity.
6.2. Total liability for direct damages is limited to the contract price (excluding VAT).
6.3. European DMT Market is not liable for indirect damages such as loss of profits, data, or business interruption.
6.4. These limits do not apply in cases of proven intent or gross negligence.
6.5. Liability arises only if the customer submits a written notice of failure with reasonable time to remedy.
6.6. Damages must be reported in writing within 48 hours of occurrence.
6.7. Customers must indemnify European DMT Market against third-party claims arising from products supplied.
Article 7. Force Majeure
7.1. In cases of force majeure, European DMT Market is not liable for damages or delays.
Article 8. Complaints
8.1. Complaints about non-conforming products must be submitted within 14 days of discovery.
8.2. If the complaint is valid, products may be replaced or orders corrected.
8.3. Maximum compensation equals the product amount minus shipping.
8.4. Lost goods:
– Not considered lost before 30 days (EU) or 45 days (worldwide).
– No reshipments for untracked shipments.
– Tracked shipments qualify for reshipment.
– No reshipments for customs seizures.
8.5. Complaints do not suspend customer obligations.
Article 9. Legal Framework
9.1. Dutch law governs all agreements.
9.2. Disputes will be submitted to the competent Dutch court unless mandatory law determines otherwise.
9.3. If any provision is invalid, the remainder stays in effect. A replacement clause will be created to match the original intent.
Article 10. Use of Products
10.1. All chemical products are strictly for laboratory research and analytical use only.
They are not for human or veterinary use, consumption, or any prohibited purposes.
10.2. Products must be handled only by qualified individuals in properly equipped laboratories.
Customers should review Material Safety Data Sheets (MSDS) prior to use.
10.3. Products are not tested by European DMT Market for safety, toxicology, or full chemical properties.
10.4. Customers may not repackage, resell, relabel, or use products to create commercial items.
10.5. Customers are fully responsible for safe handling, storage, and use.
10.6. All purchases are made under the customer’s full responsibility.
Article 11. Legality
11.1. European DMT Market does not claim its products are lawful outside the Netherlands.
Customers purchasing from abroad do so at their own risk.
11.2. These terms are governed by Dutch law. Dutch courts have exclusive jurisdiction.
11.3. Invalid provisions do not affect the remaining terms.
11.4. Failure to enforce any term is not a waiver of future enforcement.
Article 12. Website and Brand
12.1. Do not share usernames, passwords, or coupon codes. European DMT Market assumes the person logging in is the legitimate customer.
12.2. The name, logo, and branding of European DMT Market may not be used without written consent.
12.3. The website may not be used for unlawful purposes.
12.4. Any attempt to damage, overload, hack, or misuse the website will be reported to authorities.
12.5. European DMT Market may terminate website access at any time without notice.
Article 13. Hold Harmless Agreement
13.1. Customers acknowledge that products may be hazardous and certify they are legally permitted to receive them.
13.2. Products are provided without warranty, including merchantability or fitness for any purpose.
13.3. European DMT Market is not liable for consequential damages. Liability is limited to the purchase price.
13.4. Customers must not use products in violation of any law.
13.5. Customers agree to hold European DMT Market harmless from damages arising from use or misuse.
13.6. Warranties apply only if products are used according to instructions and not misused.
13.7. The disclaimer applies to all past, present, and future purchases.
13.8. Customers agree to indemnify European DMT Market against any claims arising from use of its services or products.
